Section 1 Scope and provider
These General Terms and Conditions apply to all orders placed by consumers (Section 13 German Civil Code, BGB) via the online shop of

A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside his or her trade, business or profession.

Section 2 Conclusion of contract
Section 2.1 The depiction of products in the online shop constitutes an invitation to place an order. By clicking on the BUY NOW button, you place a binding order for the respective goods. Our products are only sold for private use and in normal household quantities.
Section 2.2 We can accept your order by sending a separate order confirmation by email or by delivering the goods within five days. A confirmation of order receipt is sent immediately and automatically by email after the order is submitted and does not constitute an acceptance of the contract.
Section 2.3 If our order confirmation contains clerical or typographical errors, or if our prices as stated are incorrect due to a technical transmission error, we are entitled to contest the order, whereby it is our obligation to provide proof of our error. In this case, any payments that have been made shall be reimbursed to you without delay.
Section 3 Prices
The prices quoted on the product pages include the value added tax required by law, as well as other price components, and do not include shipping costs.
Section 4 Shipping costs
Section 4.1 The shipping fee is 5 euros per order. We accept orders from other European countries, but only ship to delivery addresses within Germany.
Section 5 Terms of delivery and reservation of self-supply
Section 5.1 We offer delivery with DHL only within Germany.
Section 5.2 Unless otherwise stated on the product page, the estimated shipping time is up to 5 business days. This estimate is based on information provided by the third party (DHL), which states that the delivery times are only an estimate. The actual delivery date can be delayed due to bad weather, traffic jams and other circumstances. The same applies to seasonal business periods, such as the pre-Christmas period and Easter.
Section 5.3 If one or more ordered products are out of stock, we reserve the right to make partial shipments at our own expense, if this is acceptable to the customer.
Section 5.4 If the products cannot be successfully delivered after three attempts, we can withdraw from the contract if the customer is responsible for the failure of delivery. In this case, any payments that have been made shall be reimbursed to you without delay.
Section 5.5 If the ordered product is not available because we were not supplied with this product by our suppliers at no fault of our own, we can withdraw from the contract. In this case, we will inform you immediately and may suggest the shipment of a comparable product. If no comparable product is available or you do not want a comparable product, we will refund any payments you have made without delay.
Section 6 Terms of payment
Section 6.1 Customers can choose to pay via Giropay, Sofort-Überweisung, PayPal and PayPal Express or credit card (VISA, Mastercard).
Section 7 Reservation of title
The goods remain our property until full payment has been made. Before transfer of ownership, any pledging, assignment as security, processing or modification without our permission is prohibited.
Section 8 Right of withdrawal
Section 8.1 Customers may cancel their orders within 14 days.
Section 8.2 The right of withdrawal does not apply to custom-made goods and goods tailored specifically to the customer’s individual needs and/or specifications.
Section 8.3 Please send the package with sufficient postage to our return address and keep the mailing receipt for your records. Upon request, we will also refund your postage costs in advance unless they are payable by you.
Section 8.4 Before returning the products to us, please call us under the telephone number +49 (0) 2233-95991-0 or contact firstname.lastname@example.org in order to notify us of the return so that we can identify and process the returned products as quickly as possible. In any case please always state your order number.
Section 8.5 Please note that the procedures specified in Sections 8.3 and 8.4 are not required for effectively exercising your right of withdrawal.
Right of withdrawal
You can withdraw from your contract within 14 days without stating any reasons. This withdrawal must be submitted either in written form (e.g. letter, fax, email) or - if the item is delivered to you before the aforementioned deadline - also by returning the goods. The period of 14 days begins after receipt of this policy in writing, but not before receipt of the goods by the recipient (in the case of recurrent delivery of similar goods not before receipt of the first partial delivery) and not before fulfilment of our information requirements under Article 246 Section 2 in conjunction with Article 1 Paragraphs 1 and 2 EGBGB (Introductory Act to the German Civil Code) as well as our obligations according to Section 312g Paragraph 1 Clause 1 of the German Civil Code (BGB) in conjunction with Article 246 Section 3 EGBGB. Timely submission of the withdrawal notice or goods is sufficient for compliance with the withdrawal period conditions. The notice must be sent to:

Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event no later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the returned goods, or you have supplied evidence of having sent back the goods, whichever comes first.
You must return the goods to us without undue delay and in any event no later than fourteen days from the date on which you communicate your withdrawal from this contract. The goods must be sent or handed over to us or to Croozer GmbH, Service- und Retouren-Center, An der Hasenkaule 10, 50354 Hürth, Germany__ or to the dealer whom you selected as the delivery address for your online order. The deadline is met if you send back the goods before the 14-day period has expired. You bear the immediate costs of returning the goods. You are only liable for any diminished value of the goods resulting from any form of handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
We offer two options for returning goods:
Collection from your home.
The cost is €25.00 for collecting Croozer vehicles and €6.90 for collecting packages suitable for shipment. With your request for a collection of the goods from your home, we will also require your declaration of withdrawal and information on the number of packages to be collected. If you would like to have the goods collected from your home, it is important that you are reachable at home during daytime hours. It is not possible to specify a date and time for the collection.

Section 9 Damage incurred during shipping
Section 9.1 Should you notice that the goods have been damaged during shipping, please report the damage without delay to the respective carrier and contact us as quickly as possible (under the telephone number +49 (0) 2233 - 95991-0).
Section 9.2 Failure to file a complaint or to contact us does not have any influence on your legal warranty rights. However, by filing a complaint with the carrier and contacting us, you will help us assert our own claims against the carrier and/or our transport insurance.
Section 10 Warranty
The warranty is provided in accordance with the applicable statutory provisions.
